Many foreign friends and HR professionals planning to recruit foreign nationals often run into the same question: if the person is already in China, can they apply for a work permit locally, or do they have to fly back to their home country first, obtain a Z visa, and then re-enter China?

For overseas applications, the step of "going abroad to apply for a Z visa" is unavoidable; this is exactly the step that is omitted in domestic applications.

Overseas Application: The Route Taken by Most "Newcomers" to Come to China

Overseas application means the applicant is still abroad and has not entered China.

The complete process is as follows: the domestic employer first submits documents via the Foreigner Work Administration Service System of China → upon approval, obtains the Notice of Foreigner's Work Permit → the foreign applicant takes this notice to the nearest Chinese embassy or consulate overseas to apply for Z visa (work visa) → enters China after obtaining the Z visa → after entry, applies for the official electronic social security card containing the information of the Foreigner's Work Permit within the specified time, and then goes to the exit-entry administration hall to apply for a work-type residence permit. Only then is the whole procedure finished.

The Notification of Foreigner's Work Permit is not the Foreigner's Work Permit. The notification is merely an "entry ticket", which is generally valid for three months and serves to allow you to apply for a Z visa. Your legal work status is only fully confirmed when you obtain the work permit after entry and then complete the application for a residence permit.

Here are two time-sensitive reminders that are easily overlooked: you must complete temporary accommodation registration promptly after entry; meanwhile, you need to apply for your work permit and residence permit within the specified time limit, or you will face consequences for missing the deadline.

Who is it suitable for?

  1. The individual is still overseas and has never entered China with a valid visa;

  2. First-time appointee to China with no legal residence status in China;

  3. Short-term work in China (within 90 days) via the route of Short-Term Work Permit Notice plus Z Visa.

For short-term projects lasting less than 90 days, there is no need to apply for an official work permit after entry. The Short-Term Work Permit Notice together with a Z Visa satisfies the requirements for short-term work, featuring a shorter and streamlined process.

Application within China: an expedited channel available only to individuals already present in China who meet the requirements

The logic for applications submitted within China is not "you can apply just because you are in China". Instead, you may apply without travelling overseas only if you are in China and fall into one of the categories specified in the policy. Common groups eligible for the domestic application channel:

  • Foreign high-end talents (Category A) who have entered China with other visas or residence permits
  • Transferred employees who wish to change employers while working in China, with unchanged positions and valid residence permits
  • Foreign spouses or children of Chinese citizens holding valid visas or residence permits
  • Foreign talents holding R-type talent visas
  • Intra-company transferees of multinational corporations
  • Persons eligible for special policies applicable to free trade zones, comprehensive innovation and reform pilot zones, etc.

......

Applications from abroad shall be submitted if the applicant is outside China; applications within China are only available for eligible applicants who are already in China. Choosing the wrong application channel may result in an extra exit trip at the minimum, or the resubmission of the entire application materials at the worst.

When to choose domestic and when to choose overseas? Just look at three factors.

First, check the immigration status. If the individual is outside China, the overseas application is the default option. If the individual is in China, refer to the categories for domestic application first.

Second, consider the time cost. If the individual is already staying in China legally and meets the requirements, a domestic application eliminates the need to travel abroad to apply for a Z visa and re-enter China. This avoids a gap period for both the employing entity and the applicant. However, if the requirements are not met, waiting unnecessarily or attempting improper arrangements will only prolong the whole process.

Third, assess the convenience of document processing. This concerns the authentication of the non-criminal record certificate and academic credentials. Category A high-end talents may adopt the commitment system for some documents and skip the authentication process. Category B applicants need complete Apostille or consular authentication, and authenticated documents are subject to validity periods. A non-criminal record certificate is generally required to be issued within the past six months. It is usually easier to process these overseas documents while staying abroad. If the applicant is in China, extra time will be spent finding agents to complete the authentication.

A few final reminders, very practical

  1. Avoid the practice of "working first and applying for permits later".Legally, working within China without a valid work permit and work residence permit constitutes irregular employment and illegal work. Both the enterprise and the individual will be exposed to risks.
  1. The work permit is tied to the employer.If you change companies or job positions, you must promptly apply for an amendment or a new permit. It is not permitted to work for another employer using an old permit.
  1. For the no-criminal-record and academic documents in the application package,the authentication process is critical. Authentication rules vary by country. Member states of the Hague Convention accept Apostille certificates, while non-Hague countries generally require embassy authentication. Plan this well in advance to prevent repeated rejections and resubmissions during review.
  1. Talent classification directly affects the level of administrative convenience.Foreign nationals working in China are classified into Categories A, B and C. Category A high-end talents enjoy more facilitative measures for in-country applications and document requirements. Category B professionals account for the majority of regular recruitment cases with relatively comprehensive document requirements. Category C is managed according to quotas and catalogues. Confirm which category the applicant falls into first.
  1. The integration of permit and card has been implemented.Since December 1, 2024, information on the Foreigner Work Permit has been embedded in the social security card. Traditional physical Foreigner Work Permits are no longer issued uniformly. Work permit information can be checked and used via the electronic social security card APP. The expression "applying for a work permit card" is no longer accurate.
  1. Short-term and long-term employment follow separate frameworks.For work stays in China of less than 90 days, applicants follow the short-term work permit notice route with a streamlined process but limited applicable scenarios. Regular recruitment for stays exceeding 90 days involves the above-mentioned choices between domestic and overseas submission as well as coordination with residence permit procedures.
