The short answer
A change of employer in China is a cancel-and-refile process, not a transfer of the existing card:
- The old employer cancels the work permit within 10 working days of the employment ending.
- The old employer issues a release letter and a cancellation certificate.
- The new employer files a new work permit within 30 days of the cancellation.
- The residence permit is updated to the new employer.
If the new position is the same as the old one and the residence permit is still valid, the new employer can file inside China without a new work permit notification. If the position changes, the file is treated as a new application, including a new notification and possibly a new Z visa.
| Same position | New position | |
|---|---|---|
| New notification | Usually not required | Usually required |
| Degree/police/medical | Already on file; not repeated | May be requested again |
| In-country filing | Available if the residence permit is valid | May require a new entry visa |
| Processing path | Change of employer | Fresh application |
| Risk if rushed | Low, if filed within 30 days | High; the old evidence may not support the new role |
Why the old permit cannot simply continue
The work permit and the work-type residence permit are employer-specific. Article 41 of the Exit-Entry Administration Law requires a work permit and a work-type residence permit, and the permit is issued against a named employer, a named position, and a specific contract.
That means:
- The old permit authorizes work for the old employer only.
- The new employer cannot “take over” the old permit.
- Working for the new employer before the new permit issues is illegal employment, even if the old permit has not expired.
The penalty structure is in Article 80: a foreigner working illegally may be fined RMB 5,000 to RMB 20,000 and, in serious cases, detained for 5 to 15 days. The new employer may be fined RMB 10,000 per illegally employed foreigner, up to RMB 100,000. A “friendly” early start is not worth the exposure.
The sequence that works
Step 1: agree the last working day and the release letter
The release letter should state the employment dates, the position, and the fact that the employment has ended without dispute. The new employer will need it. If there is a dispute, the cancellation may require a court or arbitration ruling, which can take months.
Step 2: the old employer cancels the permit
The cancellation is filed in the national work-permit system within 10 working days of the termination. The employer uploads the cancellation form, the termination proof, and the release letter, and receives a cancellation certificate.
If the old employer has dissolved or refuses to cooperate, the employee can apply to cancel the permit directly in some cities, but the process is slower and requires evidence. This is the main reason to keep employment records and to leave on documented terms.
Step 3: the new employer files within 30 days
The new employer files the new work permit within 30 days of the cancellation. The package normally includes:
- The new employment contract.
- The release letter and cancellation certificate.
- The passport and current visa or residence permit.
- The old work permit record.
- The job description and the employer’s registration documents.
If the position is unchanged, the degree, police certificate, and medical exam already on file are generally not repeated. If the position changes, the authority may require a new notification and a new document set, because the approval was tied to the old role.
Step 4: update the residence permit
Once the new work permit is issued, the residence permit is updated to reflect the new employer. The application is made at the local exit-entry administration. The permit’s remaining validity may be preserved or reset depending on the city and the new contract term.
The 30-day window and the gap problem
The 30-day window is the critical path. It runs from the cancellation, not from the last working day, although in practice they are close.
If the new application is filed within the window and the residence permit is valid, the applicant can usually remain in China throughout. If the window is missed, or the residence permit expires while the application is pending, the options narrow:
- Some cities issue a short-term stay permit to cover the gap.
- Some require the applicant to leave and re-enter on a new Z visa.
- Some treat the file as an overseas application, which restarts the notification and visa stages.
The safe plan is to have the new employer’s package ready before the old permit is canceled, and to file on the same day or the next working day.
Tax and social insurance do not pause for the permit
The immigration file is only one of three records that change when the employer changes. The other two are tax and social insurance.
- Individual income tax is withheld by the employer. A gap month can show as zero income, which may complicate a future permit renewal or permanent-residence application that relies on continuous tax records.
- Social insurance is tied to the employer’s registration. The new employer should enroll the employee from the first month of the new contract, not after the permit is issued, if the employment relationship has already started on paper.
- The labor contract should state the start date and make it conditional on the permit, so the tax and immigration records do not disagree about when employment began.
A clean transfer therefore has three aligned dates: the old contract ends, the old permit is canceled, and the new contract starts after the new permit. When those dates drift apart, the file becomes harder to explain at renewal.
Special cases
Position changes with the same employer. A promotion or a move to a different role is a change of position, not a change of employer. It is filed as a permit change within 10 working days of the change, and it may require a new notification if the new role does not match the approved category.
Intra-group transfers. A move between affiliated entities is still a change of employer if the legal entity changes. Some cities allow simplified treatment for intra-group moves, but the legal employer on the permit must be updated.
Probation or trial periods. A new employer cannot use a “trial” or “probation” arrangement to avoid the permit. The permit must name the employer before work begins.
Remote work for a foreign entity. Working remotely in China for an overseas employer is a separate question from a Chinese work permit. It can create a permanent establishment and tax exposure for the foreign employer; it is not a workaround for the Chinese permit requirement.
A checklist for the last two weeks
- Release letter signed and dated.
- Cancellation form prepared by the old employer.
- New contract signed, with the position and term matching the intended permit.
- Passport and residence permit valid for at least the expected processing period.
- New employer registered and compliant in the work-permit system.
- Filing scheduled within 30 days of cancellation.
- Start date set after the new permit, not before.
